Prediction for Healthcare bill tomorrow

I am sure that others will be making this or a similar prediction, but here is the maddux take on the fate of the bill tomorrow.

5-4 split on the court with the bill being overturned. My prediction is that John Roberts will be writing the majority opinion and it will be agreed to by Alito, Kennedy, Scalia, and Thomas. I think that Ginsburg will write her own dissent and probably grandstand by reading it from the bench. Breyer, Sotomayor, and Kagan all may do the same.

Honestly how Kagan has not been made to recuse herself from this is beyond me.

I think the bills fundamental flaw was forcing the people to buy a product. one of the key questions that was raised in the original arguments was if the government could force you to buy insurance then could they make you buy a cell phone or any other item for that matter.

everyone should have health care or what ever they want – as long as they want to pay for it. i do not ask others to pay for any of the things i want or need, so do not ask me to do that.

    Kagan is a hack. It’s a joke she’s in on this one.

  2. Good question Hans – if my memory serves – the bill lacks severability – it is all or nothing. i seem to remember that surprised me when it was voted in. For instance one of the last controversial pieces of legislation was McCain – Feingold – that was able to be severed and the pieces that were unconstitutional were removed while the whole of the bill remained.
